Our Commitment to GDPR
While amperage-flare operates primarily in Australia, we recognise that European Union residents may use our services or visit our website. We are committed to compliance with the General Data Protection Regulation (GDPR) for all individuals whose data we process, regardless of their location.
Legal Basis for Processing
We process personal data under the following legal bases:
- Contract performance: Processing necessary to deliver the pet care services you have requested
- Consent: Where you have explicitly agreed to processing for specific purposes, such as receiving service updates
- Legal obligation: Where processing is required to comply with veterinary record-keeping regulations and other legal requirements
- Legitimate interests: For improving service quality and operational efficiency, balanced against your privacy rights
Your Rights Under GDPR
If you are a European Union resident, you have the following rights regarding your personal data:
Right to Access
You may request confirmation of what personal data we hold about you and receive a copy of that data.
Right to Rectification
You may request correction of inaccurate or incomplete personal data.
Right to Erasure
You may request deletion of your personal data, subject to legal record-keeping obligations for veterinary services.
Right to Restrict Processing
You may request that we limit how we use your data in certain circumstances.
Right to Data Portability
You may request a copy of your data in a structured, commonly used, machine-readable format.
Right to Object
You may object to processing based on legitimate interests or for direct marketing purposes.
Right to Withdraw Consent
Where processing is based on consent, you may withdraw that consent at any time.
Data Transfers
Your personal data is stored on servers located in Australia. Australia is recognised by the European Commission as providing adequate data protection. Any transfers to other jurisdictions occur only when necessary for service delivery and under appropriate safeguards including standard contractual clauses approved by the European Commission.
Data Retention
We retain personal data only as long as necessary for the purposes for which it was collected:
- Veterinary consultation records: Seven years, as required by Australian veterinary regulations
- Appointment and service records: Three years from last service provision
- Email communications: Two years from last contact
- Marketing consent records: Until consent is withdrawn
After these periods, data is securely deleted or anonymised.
Data Security
We implement technical and organisational measures to protect your personal data:
- Encryption of data in transit and at rest
- Access controls limiting data access to authorised personnel only
- Regular security assessments and updates
- Staff training on data protection principles
- Secure backup procedures
Data Breach Notification
In the event of a data breach that poses a risk to your rights and freedoms, we will notify you within 72 hours of becoming aware of the breach. Notification will include the nature of the breach, likely consequences, and measures we are taking to address it.
Automated Decision Making
We do not use automated decision-making or profiling that produces legal effects or similarly significant impacts on individuals.
Children's Data
We do not knowingly process personal data of individuals under 16 years of age. Our services are intended for adult pet owners only.
